These Terms of Service govern your use of the FairTrek Nepal website and the trekking, expedition and tour services we arrange ("Services"). By using the site or booking a trip you agree to these terms.
1. Who we are
FairTrek Nepal ("we", "us") is a trekking and travel company based in Kathmandu, Nepal. You can reach us through our contact page.
2. Enquiries and bookings
Submitting a booking request or inquiry does not create a confirmed booking. A booking is confirmed only when we confirm it in writing (usually by email) and any required deposit is received. Prices are shown in US dollars, are per person unless stated, and may change until your booking is confirmed.
3. Payments
Payment instructions are sent with your confirmation. Bank or card fees charged by your provider are your responsibility. Unless your confirmation says otherwise, the balance is due before or on arrival in Nepal.
4. Changes and cancellations
Changes and cancellations are handled under our Cancellation and Refund Policy.
5. Health, fitness and risk
Trekking and climbing at altitude carry real risks, including altitude sickness, injury, severe weather and remote locations. You confirm that you are in suitable health for your chosen trip, that the information you give us is accurate, and that you will follow the instructions of your guide. Travel insurance that covers high-altitude trekking, medical treatment and emergency evacuation (including helicopter rescue) is strongly recommended and, for many trips, required.
6. Itineraries and force majeure
Itineraries are a plan, not a guarantee. Weather, road or flight disruption, landslides, political events, health emergencies and safety decisions by your guide may require changes. We will always try to offer the best alternative, but we are not liable for events outside our reasonable control.
7. Your responsibilities
You are responsible for valid travel documents, visas, vaccinations and following local laws and customs. Behaviour that endangers the group, guides or the environment may lead to removal from the trip without refund.
8. Website use
Do not misuse the site, attempt to disrupt it, scrape it in a way that harms its operation, or submit false or automated enquiries. Content on this site, including text, photos and logos, belongs to FairTrek Nepal or its licensors and may not be reused without permission.
9. Liability
To the extent allowed by law, our liability is limited to the price paid for the affected Service. Nothing in these terms excludes liability that cannot be excluded by law.
10. Governing law
These terms are governed by the laws of Nepal, and the courts of Kathmandu have jurisdiction, unless mandatory consumer law in your country says otherwise.
11. Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they were last changed.
